What is a DPO?
The DPO is responsible for ensuring that the charity they represent is informed of their obligations under the GDPR, and to provide advice on how to comply with the regulation.
Can anyone be a DPO?
The DPO can be a member of staff, or it can be outsourced on the basis of a service contract. Either way, they will have expert knowledge of the GDPR and report to the highest level of management.
The DPO must be allowed to operate in an independent manner; they must not receive instructions on how to perform their duties; complete their tasks, or the advice they give.
Who should NOT be the DPO?
The DPO must not perform any other duties that could result in a conflict of interest.
Conflicting positions may include management roles such as the CES, COO, CFO, CTO or CMO; the head of Sales, Marketing, HR or IT. Anyone who decides how or why personal data is processed.
